How Massachusetts Law Defines Drug Trafficking

Under Massachusetts General Laws Chapter 94C, Section 32E, drug trafficking is determined by the net weight of the controlled substance involved. That single factor separates it from possession with intent to distribute, where weight isn’t the threshold. Once the weight crosses the statutory line, a mandatory minimum sentence applies and can’t be suspended.

The thresholds and mandatory minimums vary by substance:

Cocaine & Class B Substances:
Cocaine trafficking begins at 18 grams. A weight of 18 to 36 grams carries a sentence of 2 to 15 years in state prison with a 2-year mandatory minimum. At 36 to 100 grams, the mandatory minimum rises to 3.5 years.

Heroin, Morphine & Opium:
At 18 grams or more but less than 36 grams, the sentence is not less than 3.5 nor more than 20 years in state prison. Higher weight tiers carry longer mandatory minimums.

Fentanyl & Fentanyl Derivatives:
Trafficking is triggered at 10 grams or more and carries a sentence of not less than 3.5 nor more than 20 years in state prison.

Marijuana:
Trafficking in marijuana is triggered at 50 pounds, with tiered penalties that increase as the weight increases.
