When Is Spousal Support Appropriate?
Spousal support is only appropriate when some financial imbalance needs to be addressed.
One of the most common situations in which spousal support is necessary is when one spouse works during the marriage while the other stays home to raise the children or only works part-time.
The spouse who worked will have an easier time adjusting to the costs of life after divorce than the spouse who did not work. The stay-at-home parent may need to return to school or seek other resources to find employment. In the meantime, spousal support is designed to help cover living costs.
The Four Types of Alimony
In Massachusetts, four types of alimony can be awarded:
- General term: regular period payment to a financially dependent spouse.
- Rehabilitative: meant to support a spouse until they become economically self-sufficient, usually granted when the recipient is expected to join the workforce after gaining the necessary skills or training.
- Reimbursement: granted to compensate a spouse who contributed to the financial resources of the other spouse during the marriage, such as paying for their career education or training.
- Transitional: meant to help a spouse adjust to a new lifestyle or location following the divorce.
