Massachusetts Child Removal Law

Massachusetts removal law governs taking a child out of the Commonwealth. Child relocation is a broader phrase that parents often use for both out-of-state and in-state moves. The distinction matters because courts generally apply a more demanding standard to moves outside Massachusetts.

Under General Laws Chapter 208, Section 30, a minor child of divorced parents who’s a Massachusetts native or has lived in the Commonwealth for five years, and who remains subject to family court custody jurisdiction, can’t be removed from Massachusetts without the consent required by the statute or a court order. Massachusetts case law also applies removal principles to unmarried parents.

A child of suitable age must consent under the statute. Suitable age doesn’t refer to a specific birthday. It concerns whether the child is mature enough for consent to have legal significance. If the child isn’t of suitable age, both parents must consent unless the court authorizes removal upon cause shown.

A non-relocating parent can contest an out-of-state move. Parents who agree should still determine whether the relocation requires court approval or changes to their custody and parenting-time terms.

Removal Standards Based on the Custody Arrangement

The family’s parenting arrangement determines how a Massachusetts court analyzes removal. The court considers the evidence, the child’s circumstances, and each parent’s interests.

Primary Physical Custody

Yannas v. Frondistou-Yannas established the real advantage standard for Massachusetts removal cases. It requires a genuine benefit to the primary custodial parent. If that threshold applies and is met, the court then evaluates whether removal serves the best interests of the child.

The analysis also accounts for the non-relocating parent’s interests. The decision depends on the family’s parenting structure and the facts supported in the proceeding, so another family’s result doesn’t determine what should happen in yours.

Shared Physical Custody
When parents share parenting responsibilities, the court evaluates removal without first requiring the moving parent to meet that threshold. Instead, the court applies the child’s best interests standard, focusing on which arrangement most appropriately serves the child’s welfare under the circumstances.

Filing a Quincy Child Removal Case in Norfolk County

Child custody and removal matters involving Quincy families proceed through Norfolk Probate and Family Court. The court also handles divorce, alimony, paternity, and related family-law matters within the county.
